Terms of Service for 3D Printing Filament Usage

1. Eligibility

1.1 You must sign this contract and agree to the terms of service, to purchase products or use our Services.

1.2 By using our Services, you represent and warrant that you meet the eligibility requirements and that all information you provide is truthful and accurate.

1.3 By using our services, you agree to pay in full no matter if you disagree or are unhappy. Disputes will be managed after payment at seller discretion.

1.4 We reserve the right to refuse service, cancel accounts, or terminate orders at our sole discretion if eligibility requirements are not met.

2. Products and Services

2.1 Our Services include the distribution, and sale of 3D printing filament in various materials, diameters, and colors.

2.2 Product images and descriptions are for reference only. Due to manufacturing tolerances, slight variations in color, texture, or diameter may occur.

2.3 We reserve the right to discontinue, modify, or substitute products at any time without notice.

2.4 Custom orders, and specialty filaments may be subject to unique terms communicated at the time of purchase.

2.5 Spools will be weighed before and after print completion. No disputes and compensations can be made. Final weights are to be made by seller, and not the customer.

3. Orders and Payments

3.1 Orders are subject to acceptance and availability. Confirmation of order receipt does not constitute acceptance; an order is deemed accepted only upon shipment.

3.2 We reserve the right to cancel or refuse any order for reasons including suspected fraud, inaccurate pricing, product unavailability, or violation of these Terms.

3.3 All prices are listed in Canadian Dollar (CAD) and exclude applicable taxes and shipping unless otherwise stated.

3.4 Payments must be completed through approved payment methods, including contracts (with witness) and direct payment.

3.5 You agree to provide accurate billing and shipping information. Failure to do so may result in delays, cancellation or extra charges. You will not be refunded for you failure to provide accurate information.

3.6 We are not responsible for any extra charges, failed prints, purge, and any other form of filament usage. You are charged on how much you use, not how much the final product weighs.

3.7 Availability times are estimates and not guarantees. We are not liable for delays caused by carriers, natural events, labor strikes, or force majeure.

4. Returns, Refunds, and Exchanges

4.1 Standard products may not be returned unless all parties agree, and a witness is present.

4.2 You must contact us for a return authorization before sending back any items. Unauthorized returns may be rejected.

4.3 Extra fees are non-refundable, except in cases of defective or incorrect products shipped by us.

4.4 Refunds, where applicable, will be processed to the original payment method within 14 business days after inspection of returned items.

4.5 Custom orders, clearance items, and opened spools of filament are non-returnable and non-refundable, except where required by law.

5. Product Use and Safety

5.1 Our filament is designed solely for 3D printing purposes.

5.2 Users are responsible for ensuring proper printer settings, calibration, and compatibility with filament type.

5.3 Certain materials may emit fumes during printing; you are responsible for ensuring adequate ventilation and safe handling.

5.4 We disclaim responsibility for:

- Damage to printers or accessories caused by misuse of filament.

- Injuries resulting from improper handling or inhalation of fumes.

- Failure to comply with local safety, environmental, or disposal regulations.

6. Warranties and Disclaimers

6.1 We warrant that products sold will substantially conform to published specifications at the time of shipment.

6.2 This warranty does not cover:

- Misuse, negligence, or improper storage.

- Normal wear and tear.

- Variations inherent to manufacturing tolerances.

6.3 Except as expressly provided, products and Services are provided “as is” and without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

7. Prohibited Uses

You agree not to use our Services or products for any unlawful, harmful, or unauthorized purposes, including but not limited to:

- Manufacturing weapons, restricted goods, or counterfeit products.

- Violating export or import regulations.

- Infringing on third-party intellectual property rights.

- Attempting to resell products in violation of distribution agreements.

8. Intellectual Property

8.1 All content on our contract/invoice, including product images, text, graphics, trademarks, and software, is owned by or licensed to us and protected by applicable intellectual property laws.

8.2 You may not copy, reproduce, modify, distribute, or exploit any content without our prior written consent.

8.3 Any feedback, suggestions, or ideas you provide may be used by us without obligation or compensation.

9. Limitation of Liability

9.1 To the fullest extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages arising out of your use of our products or Services.

9.2 Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount you paid for the specific product giving rise to the claim.

10. Third-Party Services

Our Services may contain links to third-party websites or use third-party providers (e.g., shipping companies, payment processors). We are not responsible for the actions, policies, or services of such third parties.

11. Termination

We may suspend or terminate your access to Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to us, our customers, or third parties.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on our website with the “Effective Date” updated. Continued use of Services after changes constitutes acceptance of revised Terms.
